Amendments to claims against former shareholders and upcoming court hearing
Further to the Company’s previous announcements regarding its claims against the Company's former directors and shareholders for misappropriation of the Kazakhstan Kagazy Group’s (‘KK Group’) funds, the Company provides the following update.
KK Group has this week been granted permission to amend its London High Court claims against the KK Group’s former shareholders, Maksat Arip and Baglan Zhunus (the ‘Proceedings’). The KK Group’s claims have been extended to include further alleged misappropriation of funds, together with interest and penalties paid on defaulted loans. The total amount claimed by KK Group in the Proceedings now stands at over USD 280,000,000.
A case management conference for the Proceedings has been set for 7-9th October 2015, during which directions will be given for the conduct of the Proceedings to trial. Mr Arip’s applications to: (i) discharge the GBP 72,000,000 worldwide freezing order (‘WFO’) obtained by KK Group; and (ii) fortify the cross-undertaking for damages provided by KK Group in relation to the WFO, will also be heard during the October hearing.
